The inability of a child to thrive in a Constitutionally protected God based perpetual threat and rape culture is not a fault of the child; however it does become their odious responsibility upon reaching adulthood to resolve the harms done to them. The Christian religion at its core is a toxic mechanism whereby intergenerational trauma is kept alive, active, and deeply embedded in each new generation, as it has done over the past 2,000+ years.

Toward a Living Bill of Rights for Present-Day Australia

The principle of the separation of Church and State traditionally arises from a necessity to distinguish the operations of governance from religious institutions. However, a deeper examination shows that it represents an even more fundamental boundary: the demarcation between the evidence-based physical laws of the universe ("the physical state") and the supernatural claims of spiritualism, religion, cultural tradition, indoctrination, delusion, and other subjective or unverified belief systems ("the supernatural state").

In the physical state, governance is founded upon observable, verifiable phenomena and the structured consistency of natural laws. Justice, health care, education, mental health services, and governance itself must be administered according to what can be reliably known, tested, and improved upon. This approach ensures consistency, fairness, and predictability (Rawls, 1971; Sagan, 1995).

In contrast, the supernatural state operates on claims that are not bound by empirical evidence. While such claims may hold personal or communal significance, they are inherently subjective and vary widely across cultures, communities, and individuals. When supernatural claims are permitted to guide governance or public policy, inequality, inconsistency, and systemic injustice often follow, because different groups assert mutually incompatible "truths," none of which can be universally verified (Russell, 1927).

Australia, with its rich indigenous heritage, multicultural society, and Western democratic institutions, stands at a pivotal moment. To ensure fairness and equality across generations, Australia can implement an experimental model of representative governance based explicitly on the physical state, enshrined within a Living Bill of Rights. Such an initiative would protect the rights of all citizens—including children, marginalized communities, and future generations—by grounding policy and governance in universally observable principles rather than sectarian or cultural bias (Australian Human Rights Commission, 2020).

Foundations for a Policy Proposal

A Living Bill of Rights in Australia would acknowledge that human dignity, fairness, and equality stem from our shared reality as upright bipedal Hominins/biological beings subject to the same natural laws, rather than from supernatural or traditional mandates. It would enshrine principles such as:

  1. Universal Access to Evidence-Based Education: All children must have access to education rooted in scientific understanding, critical thinking, and emotional literacy, equipping them to navigate the physical world responsibly (UNESCO, 2015).

  2. Justice Based on Observable Evidence: Legal proceedings and justice mechanisms must rely exclusively on empirical evidence, reasoned argument, and transparent procedures, free from religious or cultural dogma (UN Office on Drugs and Crime, 2016).

  3. Healthcare and Mental Health Grounded in Science: Policies must ensure that health and mental health services are provided based on the best available evidence, addressing the impacts of adverse childhood experiences (ACEs) and other trauma with compassion and effectiveness (Felitti et al., 1998).

  4. Governance by Verifiable Standards: Public administration must adhere to transparent, evidence-based methods of decision-making, ensuring accountability and minimizing the influence of unverified beliefs (OECD, 2017).

  5. Children's Rights as a Core Pillar: The Rights of the Child would be reaffirmed and expanded, recognizing children as full rights-holders whose development must be protected through evidence-based practices and policies (UN Convention on the Rights of the Child, 1989).

  6. Freedom of Belief with Separation from Policy: Individuals would retain full freedom of belief, worship, and expression, but these beliefs would not influence public policy, education curricula, or the rights of others (International Covenant on Civil and Political Rights, 1966).

  7. Equality Across Generations: Laws and policies would be assessed for their long-term impact, with mechanisms ensuring that the rights and wellbeing of future generations are given equal weight alongside present-day concerns (UN Brundtland Report, 1987).

Toward an Experimental Implementation:

Such an initiative would be groundbreaking. Australia could lead by piloting the Living Bill of Rights at local, regional, or state levels, gradually refining it based on measurable outcomes in justice, health, education, and equality.

The separation of the physical and supernatural states in governance is not merely a theoretical preference; it is an ethical imperative to protect human rights, dignity, and fairness in a complex and interconnected world. It honors the diversity of belief while safeguarding the integrity of shared governance based on what is known, observable, and improvable.

By anchoring its future in the verifiable structures of the universe, Australia can forge a just society that truly serves all generations.

In a parliamentary democracy, the parliament enjoys the benefits of democracy, while the rest of us receive a diluted and often inadequate form of representation.
