The inability of a child to thrive in a Constitutionally protected God based perpetual threat and rape culture is not a fault of the child; however it does become their odious responsibility upon reaching adulthood to resolve the harms done to them. Through no fault of their own, victim survivors of institutional child abuse are being denied the justice they deserve – simply because their perpetrator was not technically an employee.
The recent High Court decision in Bird v DP means that survivors of institutional child abuse cannot rely on the law of vicarious liability. This decision puts Australia at odds with other countries including the United Kingdom, New Zealand, Ireland and Canada.

Thank you for your email, kind words and for sharing your story. I really do appreciate you reaching out.
The response to the Bill has been incredible, and I would like to reassure you that we will do our best to lobby the government to change the laws.
Following the High Court decision (Bird v DP), we have been asking the Victorian government what they are doing to right this wrong. In November last year, I asked the then-Attorney General Jaclyn Symes a question on what are the next steps towards reforming these laws.
We know that the new Attorney General Sonya Kilkenny has met again with the national standing committee of Attorneys-General, however at this stage we have not received any further information on progress from the Victorian government.
The intention of introducing our Bill was to hold the government to account and facilitate a pathway for Victoria to be the first state to rectify vicarious liability laws. The liability of the perpetrator should not be removed because of a ‘technicality’, and we will fight hard to ensure that this reform is actioned urgently.
I’ve been working with some amazing advocates and survivors, who have suggested providing an option for advocacy, so if you do feel like writing to the Attorney-General, I have set this up on my website to facilitate that. You will also find the full speech from earlier this month that started this process.
The debate for the Bill will be on Wednesday 14 May, time is to be confirmed (it will be before midday on the day). As we are the first debate of the day it will most likely be around 10:30am. If you would like to watch the debate online, my team will share a link closer to the date. You are also welcome to attend parliament on the day, just let me know and I can arrange.
I can only imagine how frustrating it must be to have yet another barrier in the way of seeking justice, especially one labelled a ‘technicality’.
